  1. INTRODUCTION AND SCOPE

This Privacy Policy applies to all websites, mobile applications, digital portals, coaching platforms, and online communities administered by Tress Marketing Solutions, LLC (“TMS,” “we,” “us,” or “our”), a Florida limited liability company with its principal place of business at 15550 Lightwave Drive, Suite 120, Clearwater, FL 33760, including but not limited to https://www.fasterway.com and all subdomains (collectively, the “Platform”). This Privacy Policy describes how we collect, use, disclose, and safeguard your Personal Information (as defined below) when you access or use the Platform, purchase or interact with our products and services (including Digital Products, Physical Products, Programs, and Services as defined in our Terms of Use), or otherwise engage with us.

We respect your privacy and are committed to protecting it through compliance with this Privacy Policy. This Privacy Policy complies with applicable data protection laws, including but not limited to the California Consumer Privacy Act of 2018 (CCPA) as amended by the California Privacy Rights Act of 2020 (CPRA), the General Data Protection Regulation (GDPR) in the European Union/United Kingdom, and other relevant state and international privacy regulations. If you are a resident of California, the European Economic Area (EEA), the United Kingdom (UK), or another jurisdiction with similar data protection laws, you may have additional rights as described herein.By using the Platform, you consent to the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not access or use the Platform.

How do we process your information? We process your information to provide, improve, and administer our Platform and services, communicate with you, for security and fraud prevention, and to comply with law. We may also process it for other purposes with your consent. Learn more in Section 5.

In what situations and with which parties do we share personal information? We may share information in specific situations and with specific Service Providers and Third Parties. Learn more in Section 6.

How do we keep your information safe? We have organizational and technical processes and procedures in place to protect your personal information. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure. Learn more in Section 10.

What are your rights? Depending on where you are located geographically, the applicable privacy law may mean you have certain rights regarding your personal information. Learn more in Section 9.

How do you exercise your rights? The easiest way to exercise your rights is by submitting a verifiable request to [email protected] or calling 727-677-9003. We will consider and act upon any request in accordance with applicable data protection laws.

  1. DEFINITIONS

For purposes of this Privacy Policy:

  • “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device. Personal Information does not include publicly available information from government records, de-identified or aggregated consumer information, or information excluded from the scope of applicable privacy laws (e.g., health information covered by HIPAA).

  • “Sensitive Personal Information” means Personal Information that reveals: (a) social security, driver’s license, state identification card, or passport number; (b) account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; (c) precise geolocation; (d) racial or ethnic origin, religious or philosophical beliefs, or union membership; (e) the contents of a consumer’s mail, email, and text messages unless the business is the intended recipient; (f) genetic data; (g) biometric information for the purpose of uniquely identifying a consumer; (h) health information; or (i) information concerning a consumer’s sex life or sexual orientation.

  • “Service Providers” means entities that process Personal Information on our behalf and are contractually bound to use it only for the purposes we specify.

  • “Third Parties” means entities with whom we may share Personal Information for business purposes, as described below.

  1. WHAT PERSONAL INFORMATION WE COLLECT

We collect Personal Information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. In the past twelve (12) months, we have collected the following categories of Personal Information from consumers:

  • Identifiers: Such as real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol (IP) address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers. We have collected this category.

  • Personal Information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)): Such as name, signature, social security number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. We have collected this category.

  • Protected classification characteristics under California or federal law: Such as age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information). We have collected this category.

  • Commercial information: Such as records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. We have collected this category.

  • Biometric information: Such as genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data. We have collected this category (e.g., health metrics shared in Programs).

  • Internet or other electronic network activity: Such as browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement. We have collected this category.

  • Geolocation data: Such as physical location or movements. We have not collected this category in the past twelve (12) months.

  • Sensory data: Such as audio, electronic, visual, thermal, olfactory, or similar information. We have not collected this category in the past twelve (12) months.

  • Professional or employment-related information: Such as current or past job history or performance evaluations. We have collected this category (e.g., for coach applicants).

  • Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. § 1232g, 34 C.F.R. Part 99)): Such as education records directly related to a student maintained by an educational institution or party acting on its behalf. We have not collected this category in the past twelve (12) months.

  • Inferences drawn from other Personal Information: Such as a profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. We have collected this category (e.g., fitness progress inferences).

  • AI Feature Inputs and Outputs: Content you submit to AI-powered features of the Platform ("AI Features"), such as questions, messages, goals, food and activity logs, and health-related information you choose to share, together with the responses generated for you. We have collected this category. 

We also collect Sensitive Personal Information in limited circumstances, such as health data voluntarily provided during Program participation or payment details for transactions. We do not use or disclose Sensitive Personal Information for purposes other than those specified in applicable laws (e.g., to perform services, detect security incidents, or resist fraudulent activities).

We do not knowingly collect Personal Information from children under sixteen (16) years of age. If we learn that we have collected such information without verifiable parental consent, we will delete it promptly.

  1. SOURCES OF PERSONAL INFORMATION

We obtain the categories of Personal Information listed above from the following sources:

  • Directly from you: For example, from forms you complete on the Platform, preferences you express or provide through our customer service, or purchases you make.

  • Indirectly from you: For example, from observing your actions on the Platform, such as through cookies, web beacons, or similar technologies.

  • From third parties: For example, from our Service Providers (e.g., payment processors like Stripe or PayPal), business partners (e.g., affiliate coaches), or analytics providers (e.g., Google Analytics, HubSpot). We may also collect limited data from public databases, marketing partners, social media platforms, and other outside sources.

  • Automatically as you navigate through the Platform: Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.

  1. HOW WE USE YOUR PERSONAL INFORMATION

We only collect and process Personal Information that is necessary for the stated purposes outlined below. We may use or disclose the Personal Information we collect for one or more of the following business purposes:

  • To fulfill or meet the reason you provided the information, such as to process your requests, transactions, payments, and to deliver products or services.

  • To provide, support, personalize, and develop our Platform, products, and services, including to create and maintain your account, facilitate Program participation, and track fitness progress.

  • To operate the AI Features, including generating responses to your inputs, maintaining conversation context, and monitoring the AI Features for accuracy, safety, and misuse. 

  • To create, maintain, customize, and secure your account with us.

  • To process your requests, purchases, transactions, and payments and prevent transactional fraud.

  • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.

  • To personalize your Platform experience and to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through our Platform, third-party sites, and via email, SMS, or text message (with your opt-in consent, where required by law; standard messaging rates apply)

  • To help maintain the safety, security, and integrity of our Platform, products and services, databases and other technology assets, and business.

  • For testing, research, analysis, and product development, including to develop and improve our Platform, products, and services.

  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.

  • As described to you when collecting your Personal Information or as otherwise set forth in applicable privacy laws.

  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about our Platform users is among the assets transferred.

If you are located in the EU or UK, this subsection applies to you. The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your Personal Information. As such, we may rely on the following legal bases to process your Personal Information: Consent (e.g., for marketing emails); Performance of a Contract (e.g., delivering Programs); Legitimate Interests (e.g., improving services, fraud prevention, where interests do not outweigh your rights); Legal Obligations (e.g., responding to subpoenas); and Vital Interests (e.g., protecting safety).

We will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

  1. SHARING AND DISCLOSURE OF PERSONAL INFORMATION

We may disclose your Personal Information to Service Providers and Third Parties for a business purpose. In the past twelve (12) months, we have disclosed the following categories of Personal Information for business purposes: Identifiers; California Customer Records Personal Information; Protected classification characteristics; Commercial information; Biometric information; Internet or other electronic network activity; Professional or employment-related information; and Inferences.

  • Service Providers: We engage Service Providers to perform functions on our behalf, such as hosting (e.g., Kajabi, Vidapp), payment processing (e.g., Stripe, PayPal, Shopify), email marketing (e.g., HubSpot), analytics (e.g., Google Analytics, Meta Pixel, Pinterest Pixel), customer support, and advertising. These entities are contractually obligated to use Personal Information only for the services they provide to us and to maintain its confidentiality and security. 

  • Artificial Intelligence Service Providers: We use third-party providers of large language model technology to operate the AI Features, as described in Section 7 below. 

  • Third Parties: We may share Personal Information with affiliates, partners, and third parties for marketing, advertising, or other uses. For example, we may share identifiers and internet activity with advertising networks (e.g., Facebook, Google) to serve targeted ads. In the past twelve (12) months, we have sold or shared Personal Information in the categories of Identifiers and Internet or other electronic network activity (e.g., for cross-context behavioral advertising).

  • Business Transfers: We may share or transfer your Personal Information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

  • Legal Requirements: We may disclose Personal Information to comply with a court order, law, or legal process, including to respond to any government or regulatory request.

  • Other Disclosures: We may disclose your Personal Information to enforce or apply our Terms of Use and other agreements, including for billing and collection purposes; or if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of TMS, our customers, or others.

We do not sell or share Personal Information of consumers we know are under sixteen (16) years of age without affirmative authorization.

  1. ARTIFICIAL INTELLIGENCE FEATURES

Certain features of the Platform, including features of the FASTer Way mobile application, use artificial intelligence, including large language model technology provided by third-party service providers ("AI Features"). This Section describes how your Personal Information is handled when you use the AI Features.

What is processed. When you use an AI Feature, the content you submit (such as questions, messages, goals, food and activity logs, and any health-related or other sensitive information you choose to include), together with related account and Program information needed to generate a useful response and your prior interactions with the AI Feature, is transmitted to our AI service provider to generate a response. We refer to this content as "AI Inputs" and to the responses as "AI Outputs."

Who processes it. Our AI service provider is currently Anthropic, PBC, which processes AI Inputs on servers located in the United States. Our AI service providers are Service Providers under this Privacy Policy. They are contractually permitted to use AI Inputs and AI Outputs only to provide the service to us and are prohibited from using them to train or improve their own models or for any other purpose. Our AI service provider retains AI Inputs and AI Outputs only as long as needed to generate a response and for limited security and abuse-monitoring purposes, not to exceed 30 days. We may change AI service providers from time to time and will update this Privacy Policy when we do.

How we use it. We use AI Inputs and AI Outputs to operate and deliver the AI Features to you, to maintain context within your conversations, to monitor the AI Features for accuracy, safety, and misuse, and to improve the AI Features. Authorized FASTer Way personnel may review AI Inputs and AI Outputs for these purposes. We do not sell AI Inputs or AI Outputs, and we do not share them for cross-context behavioral advertising.

Sensitive and health information. The AI Features are designed to support your Program and may invite you to share health-related information such as weight, measurements, dietary habits, energy and sleep, and wellness goals. This is Sensitive Personal Information. By submitting such information to an AI Feature, you consent to its processing as described in this Section. Please do not submit information you do not wish to be processed by our AI service provider, and do not submit Personal Information about other people.

Automated processing. AI Outputs are generated automatically and are not reviewed by a human before they are shown to you unless we tell you otherwise. The AI Features do not make decisions that produce legal or similarly significant effects about you. Where required by law, you may request human review of an automated output by contacting [email protected].

Your rights. The rights described in Section 9, including the rights to access, delete, and correct Personal Information and to limit the use of Sensitive Personal Information, apply to AI Inputs and AI Outputs. Deleting your account deletes your AI conversation history from our systems [within 30 days].

  1. COOKIES AND TRACKING TECHNOLOGIES

We use cookies, web beacons, pixels, and similar tracking technologies to enhance your experience on the Platform, analyze usage, and deliver personalized content and advertising. Cookies are small data files stored on your device.

  • Essential Cookies: Necessary for the Platform to function, such as maintaining sessions and security.

  • Analytics Cookies: Collect information about how you use the Platform (e.g., pages visited, time spent).

  • Marketing Cookies: Used to track visitors across websites to display relevant ads.

When you first visit the Platform, a cookie banner will appear allowing you to accept, reject, or manage preferences for non-essential cookies. You can withdraw consent at any time via the banner or by contacting us. However, rejecting cookies may limit functionality.

We respect browser signals such as Global Privacy Control (GPC) for opting out of sales/sharing.

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy. California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

  1. YOUR PRIVACY RIGHTS

Depending on your jurisdiction, you may have the following rights regarding your Personal Information:

  • Right to Know/Access: Request disclosure of the categories and specific pieces of Personal Information we have collected about you, including sources, business purposes, and third parties with whom it was shared.

  • Right to Delete: Request deletion of your Personal Information, subject to certain exceptions (e.g., to complete transactions or comply with legal obligations).

  • Right to Correct: Request correction of inaccurate Personal Information.

  • Right to Opt-Out of Sales/Sharing: Opt out of the sale or sharing of your Personal Information for targeted advertising. Use the “Do Not Sell or Share My Personal Information” link on the Platform or email [email protected].

  • Right to Limit Use of Sensitive Personal Information: Limit our use of Sensitive Personal Information to necessary purposes.

  • Right to Non-Discrimination: We will not discriminate against you for exercising these rights, such as by denying services or charging different prices.


For California residents: You may make up to two (2) requests per twelve (12) months. We will respond within forty-five (45) days, extendable by forty-five (45) days with notice. If we decline to take action regarding your request, you may appeal our decision by emailing us at [email protected]. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.

For EEA/UK residents under GDPR: Additional rights include objection to processing, restriction of processing, data portability, and withdrawal of consent. Our legal basis for processing includes consent, contract performance, legitimate interests (e.g., marketing), and legal obligations. You may lodge a complaint with your local supervisory authority.To exercise any rights, submit a verifiable request to [email protected] or call 727-677-9003. We may require verification (e.g., matching provided information to our records).   1. DATA SECURITY AND RETENTION

We have implemented appropriate technical and organizational security measures designed to protect the security of any Personal Information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.

We retain Personal Information for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements. When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize such information.

  1. INTERNATIONAL TRANSFERS

If you are located outside the United States, your Personal Information may be transferred to and processed in the United States or other countries where our servers or Service Providers are located. We ensure such transfers comply with applicable laws, such as through Standard Contractual Clauses under GDPR.

  1. CHANGES TO THIS PRIVACY POLICY

We reserve the right to amend this Privacy Policy at our discretion and at any time. When we make changes, we will post the updated notice on the Platform and update the notice’s effective date. Your continued use of our Platform following the posting of changes constitutes your acceptance of such changes.
